Terms and Conditions Agreement

Welcome! These terms and conditions ("Agreement") govern your use of our direct-to-consumer laboratory testing services ("Services"). By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you may not use our Services.
1. Services Provided
1.1 Description: Our platform offers direct-to-consumer laboratory testing services, allowing individuals to order and receive specific medical tests directly. These tests are listed on our website.
1.2 Accuracy: While we strive to provide accurate and reliable results, no testing method is infallible. Results may vary due to factors such as sample collection, handling, shipping, and individual health conditions.
1.3 Lab Testing: We utilize reputable national laboratory companies to process specimens. While these labs aim to process specimens promptly, delays may occur due to logistical issues, staff errors, limited reagents, mechanical failures, or lost specimens. If a test cannot be processed or results are not released, you will not be charged for the test. You may either return to the lab for a redraw or request a refund.
1.4 Lab Processing: We cannot guarantee the timing of results. Common tests typically take 24-48 hours, but others may take 2-4 weeks, depending on the lab’s location and logistics. Delays may occur due to shipping or processing times, and we are unable to expedite lab results.
1.5 Provider Appointments: Do not schedule physician or provider appointments with the expectation that test results will be available on a specific day. We recommend scheduling appointments after receiving your results or allowing sufficient time for processing.
1.6 Medical Oversight: Independent healthcare providers review test results for critical or priority findings. Any such results will prompt an alert via call, text, or email, with attempts to contact you made at least three times. Non-critical abnormal results will not warrant an alert and should be reviewed with your healthcare provider. Medical oversight providers do not offer medical advice or interpretation of results.
2. Privacy and Data Security
2.1 Confidentiality: Your privacy is important to us. Personal and medical information collected during testing will be handled in accordance with our Privacy Policy and applicable laws.
2.2 Data Security: We use industry-standard measures to secure your data. However, no method of electronic transmission or storage is entirely secure, and we cannot guarantee absolute security.
3. Ordering and Payment
3.1 Ordering Process: Orders for testing can be placed through our website or mobile application. By placing an order, you agree to pay the applicable fees for the selected tests.
3.2 Payment: Payment is required in full at the time of order placement. We work with third-party payment processors that accept most major payment methods. Prices are subject to change without notice.
4. Cancellations, Refund Policy, and Disputes
4.1 Cancellation: You may cancel an order before testing begins. Credit card transaction fees may apply. Cancellations after testing has commenced may not be possible.
4.2 Refunds: Refunds may be issued at our discretion, depending on the circumstances. Refunds will be processed using the original payment method and may take 2-7 days to reflect.
4.3 Disputes: Payment disputes may be raised with our payment processors. However, initiating a dispute will result in the termination of your account. If you believe a refund is warranted, contact us, and we will investigate the matter promptly.
5. Use of Results
5.1 Personal Use: Test results are for personal use only and should not replace professional medical advice or diagnosis.
5.2 Third Parties: You may authorize healthcare providers or third parties to view your results. It is your responsibility to ensure recipients understand the limitations of the results.
6. Limitation of Liability
6.1 Disclaimer: To the fullest extent permitted by law, we disclaim all warranties regarding the accuracy, reliability, or fitness for a particular purpose of the Services or results.
6.2 Limitation: We are not liable for indirect, incidental, or consequential damages resulting from the use or inability to use our Services.
7. Amendments
7.1 Changes to Agreement: We reserve the right to modify this Agreement at any time. Changes will take effect upon posting on our website. Continued use of the Services indicates acceptance of any changes.
8. Governing Law
8.1 Jurisdiction: This Agreement is governed by the laws of Texas, USA, without regard to its conflict of law principles.
